KrewSynk Terms of Service

These Terms of Service ("Terms") govern your use of KrewSynk ("we," "us," "our"), a field management platform for construction companies and their crews. By creating an account or using the service, you agree to these Terms. If you are agreeing on behalf of a company, you confirm you have authority to bind that company.

1. The Service

KrewSynk provides web and mobile software for managing construction jobs, scheduling crews, tracking time, documenting work with photos, and producing reports. We provide the service on a subscription basis and may add, change or remove features over time.

2. Accounts

• An account belongs to a company. The company's administrator creates and manages user accounts for its crew and staff.
• You are responsible for keeping your login credentials confidential and for activity that occurs under your account.
• You must provide accurate information and keep it current.
• The company administrator is responsible for who they grant access to, and for removing access when someone leaves.

3. Free Trial

New companies receive a 30-day free trial. No payment method is required to start. During the trial you choose a user tier, which sets how many people can be added.

We send reminders as the trial nears its end. If no plan is selected by the end of the 30 days, the account becomes read-only — your data remains visible but no new entries can be created — until a plan is chosen. See Section 8 for how long data is retained after that.

4. Subscriptions and Payment

• Subscriptions renew automatically at the end of each billing period until cancelled.
• Payments are processed by Stripe. We do not store full card numbers.
• Prices are in US dollars and exclude any applicable sales tax, which is added where required.
• If you subscribe during a trial, billing begins when the trial ends — you keep the remaining trial days.
• We may change prices with at least 30 days' notice before your next renewal.

5. Cancellation and Refunds

• You may cancel at any time from the billing page. Cancellation takes effect at the end of the current billing period — you keep access until then.
• We do not provide partial refunds for unused time in a period already paid for.
• The 30-day free trial exists so you can evaluate the service before paying.

6. Failed Payments

If a payment fails, we email you and retry. If it remains unpaid, the account becomes read-only after approximately 15 days. Updating your payment method restores full access.

7. Your Data

• You own your data. Jobs, photos, time entries, documents and everything else your company puts into KrewSynk remain yours.
• We process that data solely to provide and operate the service for you.
• You can export or request a copy of your data at any time while your account is active.
• Location data is captured only at the moment a crew member clocks in and clocks out. We do not perform continuous or background location tracking.
• How we handle personal information is described in our Privacy Policy.

8. Data Retention After Cancellation

If a subscription ends or a trial lapses without a plan being selected:

• The account becomes read-only. Your data stays accessible so you can review or export it.
• After 30 days in that state, the account and its data are scheduled for deletion.
• Deletion is permanent and cannot be reversed. Export anything you need before then.

9. Acceptable Use

You agree not to:

• Use the service unlawfully, or to store or transmit unlawful content
• Attempt to access another company's data, or probe, scan or test the security of the service
• Upload malware, or interfere with the service's operation or availability
• Resell or redistribute the service without our written agreement
• Reverse engineer the software except where that right cannot lawfully be excluded

We may suspend an account that breaches this section. Where circumstances allow, we will contact you first.

10. Intellectual Property

KrewSynk, its software, design and branding remain our property. These Terms grant you a limited, non-exclusive, non-transferable right to use the service during your subscription. Nothing here transfers ownership of the software to you, and nothing transfers ownership of your data to us.

11. Third-Party Services

KrewSynk relies on third parties to operate, including Stripe for payments, Cloudflare R2 for file storage, Resend for email, and Firebase for push notifications. Their handling of data is governed by their own terms.

12. Availability

We aim to keep KrewSynk available at all times but do not guarantee uninterrupted service. Maintenance, updates and circumstances outside our control may cause downtime. We are not liable for losses arising from unavailability.

13. Termination

• You may stop using the service and cancel at any time.
• We may suspend or terminate an account that breaches these Terms, that is used unlawfully, or where payment remains unresolved.
• On termination, the retention and deletion timeline in Section 8 applies.

14. Disclaimers

The service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

KrewSynk is a record-keeping tool, not a system of legal record. Time entries, GPS coordinates, photos and reports are recorded as submitted by your users. You are responsible for verifying their accuracy before relying on them for payroll, billing, compliance, or any legal purpose.

15. Limitation of Liability

To the fullest extent permitted by law, our total liability for any claim arising out of or relating to the service is limited to the amount you paid us in the twelve months before the event giving rise to the claim. We are not liable for indirect, incidental, special or consequential damages, or for lost profits, revenue or data.

16. Changes to These Terms

We may update these Terms. If a change is material, we will give notice by email or within the application before it takes effect. Continuing to use the service after that constitutes acceptance.

17. Governing Law

These Terms are governed by the laws of the Commonwealth of Pennsylvania, United States, without regard to its conflict of laws rules. Any dispute will be brought in the state or federal courts located in Pennsylvania.
